Armbruster Dripps Blotevogel LLC partners Michael Blotevogel and Charles Armbruster recently defeated pre-trial motions by a doctor in a medical malpractice case in which their client’s husband died one day after the husband went to an emergency room and told the doctor he was experiencing shortness of breath. The doctor discharged the patient within two hours, despite a finding of mild congestive heart failure. The Southern District of Illinois found there was sufficient evidence that the doctor’s conduct was a proximate cause of the patient’s death.
